    1. Acceptance of Terms

    By creating an account or using OptInFix, operated by Peakenza Software Services, you agree to these Terms of Service. If you do not agree, do not use the service.

    2. Service Description

    OptInFix, operated by Peakenza Software Services, provides embeddable consent forms, an audit vault, webhook delivery, and proof generation to help your business meet TCPA and 10DLC requirements. We are a tool — you remain responsible for the lawful use of the data you collect.

    3. Account Eligibility and Security

    • You must be 18+ and represent a legitimate US business to use OptInFix for SMS consent collection.
    • You are responsible for keeping your credentials secure and for all activity under your account.
    • You must provide accurate company information (legal name, US phone, business email).

    4. Acceptable Use

    You agree not to: (a) collect consent for unlawful campaigns; (b) misrepresent your business; (c) reverse engineer the platform; (d) attempt to access data that does not belong to you; (e) use OptInFix to send spam or harass end users.

    5. Customer Data and Privacy

    You retain ownership of consent records and brand data you upload. You grant us a limited license to host, process, and display that data solely to operate the service.

    6. Subscriptions, Billing, and Taxes

    • Paid plans are subscription products billed in advance on a recurring basis (monthly or yearly, depending on your selected plan).
    • Charges are processed by our payment provider Paddle and may appear on your billing statement with Paddle as merchant of record.
    • You authorize recurring charges until cancellation.
    • Applicable taxes may be added based on billing country and local requirements.
    • Pricing may change with at least 30 days notice before renewal.

    7. Cancellation and Refund Policy

    • You may cancel at any time from your account billing settings.
    • Cancellation stops future renewals and your plan remains active until the end of the current paid period.
    • Unless required by law, subscription fees already paid are non-refundable.
    • If you believe a charge is incorrect, contact support before filing a chargeback so we can investigate promptly.

    8. Suspension and Termination

    We may suspend or terminate accounts that violate these Terms, involve unlawful activity, abuse the platform, or pose risk to other users or infrastructure.

    9. Intellectual Property

    The OptInFix platform, including software, branding, and documentation, is owned by OptInFix and protected by applicable intellectual property laws. These Terms do not transfer ownership rights to you.

    10. Disclaimer

    OptInFix is provided “as is.” We do not provide legal advice. While we follow industry best practices for TCPA/10DLC compliance, you are responsible for ensuring your campaigns comply with all applicable laws.

    11. Limitation of Liability

    To the maximum extent permitted by law, OptInFix’s total liability arising out of these Terms is limited to the fees you paid in the 12 months preceding the claim.

    12. Governing Law

    These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles.

    13. Changes to These Terms

    We may update these Terms from time to time. If we make material changes, we will provide notice in the app, by email, or both.
